Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Askie platform ("Service"), operated by Acevestor Software Inc.

By creating an account or using the Service, you ("Subscriber," "you," or "your") agree to be bound by these Terms. If you do not agree, do not use the Service.
1.Acceptance of Terms
By registering for an account, clicking "I agree," or otherwise accessing or using the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you are using Askie on behalf of a business, you represent that you have authority to bind that business to these Terms.
2.Description of Service
Askie is a software-as-a-service platform built for personal care businesses. The Service includes:
- Appointment scheduling and calendar management
- Client communication via SMS, WhatsApp, and email
- Client relationship management (CRM)
- Staff management and scheduling
- Review and feedback generation
- Business analytics and reporting
Features vary by subscription plan. We reserve the right to modify, add, or remove features with reasonable notice.
3.Account Registration
To use Askie, you must:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your login credentials confidential and not share them with unauthorized parties
- Notify us immediately at support@getaskie.com if you suspect unauthorized access to your account
You are responsible for all activity that occurs under your account. Each subscription is for one business. Creating multiple accounts to circumvent billing or usage limits is prohibited.
4.Free Trial
New Subscribers receive a 1-month free trial upon registration. No payment is required during the trial period.
- At the end of the trial, your account will automatically convert to a paid subscription plan
- You will be charged on the day your trial ends unless you cancel before that date
- To cancel before being charged, you must cancel through your account settings or contact support@getaskie.com prior to trial expiry
5.Subscription and Billing
5.1 Billing
Subscriptions are billed on a recurring basis (monthly or annually) via Stripe. By providing payment information, you authorize Askie to charge your payment method for the applicable subscription fees.
5.2 Price Changes
We will provide at least 30 days' notice of any price changes via email to your registered address. Continued use of the Service after the effective date of a price change constitutes acceptance.
5.3 No Refunds
All payments are non-refundable. There are no partial or pro-rated refunds for unused time within a billing period. If you cancel, your account remains active and fully functional until the last day of your current billing period, after which it will not renew.
5.4 Failed Payments
If a payment fails, we will attempt to notify you and may suspend access to the Service until payment is resolved. Prolonged non-payment may result in account termination.
6.Cancellation and Termination
6.1 Cancellation by You
You may cancel your subscription at any time through your account settings or by contacting support@getaskie.com. Cancellation takes effect at the end of the current billing period. No partial refunds are issued.
6.2 Termination by Askie
We reserve the right to suspend or terminate your account immediately and without notice if you:
- Violate these Terms or our Acceptable Use policy (Section 9)
- Engage in fraudulent, abusive, or illegal activity
- Fail to pay subscription fees after reasonable notice
6.3 Effect of Termination
- Your access to the Service ends at the conclusion of the current billing period (or immediately in the case of termination for cause)
- Your data remains available for export for up to 12 months following the end of your subscription
- After 12 months, all account data, including client information stored under your tenant context, will be permanently and irreversibly deleted
We recommend exporting your data promptly after cancellation.
7.Your Data
7.1 Ownership
You retain full ownership of all data, content, and information you upload or create within Askie, including your client lists, appointment records, service configurations, and business information. This ownership of your data is a foundational principle of Askie — we are not a marketplace that claims rights to your client relationships.
7.2 License to Askie
By using the Service, you grant Acevestor Software Inc. a limited, non-exclusive, royalty-free license to access, store, and process your data solely as necessary to provide and operate the Service. This license does not give us rights to use your data for any other purpose.
7.3 Feedback
If you provide feedback, suggestions, or feature requests to Askie, you grant us an irrevocable, perpetual, royalty-free license to use that feedback to improve the Service. We are not obligated to implement any feedback.
7.4 Data Export
You may export your data at any time through the platform. Exports include your client list, appointment history, and other business data in a portable format.
8.Client Data Responsibilities
As a Subscriber, you use Askie to store and manage information about your clients (names, phone numbers, email addresses, and appointment history). You are the data controller of that information. This means:
- You are responsible for having a lawful basis to collect, store, and communicate with your clients
- You are responsible for complying with applicable privacy laws in your jurisdiction (including PIPEDA and any applicable provincial laws in Canada, and CCPA for California-based clients)
- You must not use Askie to collect, store, or process client data in a manner that violates applicable law
- You must obtain any consents required before sending communications to your clients via Askie (e.g., SMS opt-in)
Acevestor processes your client data on your behalf as a data processor and will not use it for our own marketing or share it with unauthorized parties.
9.Acceptable Use
You agree to use Askie only for lawful purposes and in accordance with these Terms. The following are prohibited:
- Spam and unsolicited messaging — using Askie to send bulk unsolicited commercial messages, spam, or communications to individuals who have not consented to receive them
- Reselling or sublicensing — reselling, sublicensing, white-labelling, or otherwise granting third-party access to the Service without our written consent
- Minors' data — storing or processing personal information of individuals under the age of 13
- Illegal services — using the platform in connection with any unlawful activity, including facilitating services that are illegal in your jurisdiction
- Automated scraping — using bots, crawlers, or automated tools to scrape, harvest, or extract data from the platform
- Impersonation — creating accounts or listings that misrepresent your identity or impersonate another business or individual
- Security circumvention — attempting to bypass authentication, exploit vulnerabilities, interfere with security controls, or circumvent rate limits
We reserve the right to investigate and take appropriate action for any violation of these rules, including suspension or termination of your account.
10.Intellectual Property
10.1 Askie's IP
Acevestor Software Inc. owns all rights, title, and interest in the Askie platform, including its software, branding, design, trademarks, and underlying technology. Nothing in these Terms transfers any intellectual property rights to you.
10.2 Your Content
You retain ownership of all content and data you bring into or create within Askie, as described in Section 7.
10.3 No Reverse Engineering
You may not reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service.
11.Third-Party Services
Askie integrates with third-party services including Stripe, Twilio, Mailgun, and Google. Your use of these integrations is subject to the respective providers' terms and privacy policies. Askie is not responsible for the availability, accuracy, or conduct of any third-party service.
Links or integrations within the Service do not constitute an endorsement of any third party.
12.Service Level
We aim to maintain 99.9% uptime for the Askie platform, excluding:
- Scheduled maintenance (communicated in advance)
- Events beyond our reasonable control (force majeure)
- Downtime caused by third-party infrastructure providers
We do not guarantee uninterrupted or error-free operation of the Service.
13.Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, THAT IT WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY ERRORS WILL BE CORRECTED.
14.Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ACEVESTOR SOFTWARE INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF:
- CAD $100, OR
- THE TOTAL FEES YOU PAID TO ASKIE IN THE 12 MONTHS PRECEDING THE CLAIM
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
15.Indemnification
You agree to indemnify, defend, and hold harmless Acevestor Software Inc. and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
- Your use of the Service in violation of these Terms
- Your violation of any applicable law or third-party rights
- Any claim by your clients arising from your use of Askie to store or communicate with them
- Any content or data you submit through the platform
16.Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
You agree that any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of British Columbia, Canada.
17.Dispute Resolution
Before initiating formal legal proceedings, you agree to first contact us at support@getaskie.com and attempt to resolve the dispute through good faith negotiation. If the dispute cannot be resolved informally within 30 days, either party may pursue remedies in the courts of British Columbia as set out in Section 16.
18.Changes to These Terms
We may update these Terms from time to time. We will provide at least 30 days' notice of material changes by emailing the address associated with your account.
If you continue to use the Service after the updated Terms take effect, you are agreeing to the revised Terms. If you do not agree to the updated Terms, you must cancel your account before the effective date.
19.General Provisions
- Entire Agreement
- These Terms, together with our Privacy Policy, constitute the entire agreement between you and Acevestor Software Inc. regarding the Service and supersede all prior agreements.
- Severability
- If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
- No Waiver
- Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
- Assignment
- You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.
- Language
- These Terms are provided in English. In the event of any conflict with a translated version, the English version controls.
